Application for Divorce
Most UsedThe main form to apply for divorce. Requires 12 months separation.
Requirements:
- Married for at least 2 years (or court permission)
- 12 months separation
- Marriage certificate
- Arrangements for children under 18
Response to Divorce Application
File if you are the respondent and want to respond to divorce proceedings.
Requirements:
- Response within 28 days (or 42 days if overseas)
- Only needed if you oppose the divorce
Affidavit of Service (Divorce)
Proof that you have served the divorce application on your spouse.
Requirements:
- Must be filed before the hearing
- Required if sole applicant
Initiating Application - Parenting Orders

Notice of Child Abuse, Family Violence or Risk
Most UsedMandatory form when there are family violence or child safety concerns.
Requirements:
- Required in ALL parenting matters
- Must be filed with initiating application or response
Initiating Application - Property & Spousal Maintenance
Most UsedStart proceedings for property settlement and/or spousal maintenance orders.
Requirements:
- Genuine steps certificate
- Financial statement
- Section 60I certificate if children involved
Financial Statement
Most UsedDetailed disclosure of your financial position including assets, liabilities, income.
Requirements:
- Required in all property matters
- Must include all assets and liabilities
- Superannuation values required
Superannuation Information Form
Request information from your superannuation fund for property proceedings.
Requirements:
- Send to your super fund
- Fund must respond within 28 days
Application for Consent Orders
Most UsedJoint application when both parties agree on property and/or parenting arrangements.
Requirements:
- Both parties must sign
- Draft consent orders attached
- Financial disclosure for property matters
Draft Consent Orders
The actual orders you want the court to make (attached to application).
Requirements:
- Clear and specific terms
- Properly formatted for court
Application for Contravention
Apply when the other party has breached (not followed) court orders.
Requirements:
- Evidence of breach
- Existing court orders
- Affidavit in support
Application for Enforcement Warrant
Seek enforcement of property orders including seizure and sale.
Requirements:
- Existing property orders
- Evidence of non-compliance
Interlocutory Application
Apply for urgent or interim orders during existing proceedings.
Requirements:
- Existing proceedings
- Affidavit in support
- Genuine steps statement
Application for Location Order
Request the court to help locate a child who has been taken or hidden.
Requirements:
- Urgent circumstances
- Affidavit explaining situation
Application for Recovery Order
Request the return of a child who has been wrongfully taken or retained.
Requirements:
- Evidence child has been taken/retained
- Urgent circumstances
Reduced Filing Fees
You may be eligible for reduced filing fees if you hold a Commonwealth concession card (Health Care Card, Pensioner Concession Card) or are experiencing financial hardship. The reduced fee for most applications is approximately 1/3 of the standard fee.
