What is Legal Aid?

Legal Aid provides free or subsidised legal services to people who can't afford private solicitors. Each state/territory has its own Legal Aid Commission:

    Eligibility Requirements

    Financial Test

    You must have limited income and assets. Generally:

  • Centrelink recipients usually qualify
  • Low-income earners may qualify
  • Significant assets usually disqualify

    Merit Test

    Your case must have reasonable prospects of success.

    Matter Type Test

    Legal Aid prioritises:

  • Children's matters (especially safety concerns)
  • Family violence related matters
  • Certain property matters

    What's Usually NOT Covered

    - High-asset property settlements

  • Divorce applications (simple matters)
  • Matters where you can afford private representation

    How to Apply

    Step 1: Check Eligibility

    Use the Legal Aid website for your state to see if you might qualify.

    Step 2: Gather Documents

    You'll need:

  • Income proof (Centrelink, pay slips)
  • Asset information
  • Details of your matter

    Step 3: Apply

    Online, phone, or in-person at Legal Aid offices.

    Step 4: Assessment

    Legal Aid assesses your application and notifies you.
