After Divorce: What Are the Next Steps?

Your divorce is final. Now what? Property settlement deadlines, name changes, updating documents, and moving forward.

Important Deadlines

Property Settlement: 12 Months

Once your divorce is final, you have 12 months to apply to the court for property orders. After this, you need the court's permission (which isn't always granted).

Don't wait until the last minute. Start property discussions before or immediately after divorce.

Superannuation

Super splitting must be part of your property settlement. The same 12-month deadline applies.

Updating Your Records

Government

- Medicare: Update your details

  • Centrelink: Report change in relationship status
  • ATO: Update personal details
  • Electoral roll: Update if moving

    Financial

    - Bank accounts (remove ex-spouse if joint)

  • Credit cards
  • Loans (refinance if needed)
  • Insurance policies
  • Superannuation beneficiaries

    Legal

    - Will (update urgently - your ex may still inherit!)

  • Power of attorney
  • Property titles (after settlement)

    Personal

    - Passport (if changing name)

  • Driver's licence
  • Vehicle registration
  • Subscriptions and memberships

    Changing Your Name

    Options

    - Revert to maiden name

  • Keep married name
  • Use either name without formal change

    Process

    For most purposes, your divorce certificate and birth certificate are sufficient. No need for a formal name change application.
