Methods for Dividing Retirement Benefits
Understanding the different approaches to retirement division
Present Value Method
Calculate the current value of future benefits and award that amount. One spouse keeps the pension; the other gets equivalent assets.
Shared Interest Method
Both spouses share in the actual retirement benefits when they are paid. Each receives their share at retirement.
Coverture Formula
Divides only the portion earned during marriage. Formula: (Years married while employed / Total years employed) x 50%.
Understanding QDROs
A Qualified Domestic Relations Order (QDRO) is a legal document that directs a retirement plan to pay a portion of the participant's benefits to an alternate payee (usually the former spouse). It's required to divide most employer-sponsored retirement plans.
Get the QDRO drafted and submitted to the plan administrator as soon as possible. Delays can create problems if the employee changes jobs or the plan terms change.
QDRO Best Practices
- A QDRO is required to divide most employer-sponsored retirement plans
- The plan administrator must approve the QDRO before it's effective
- QDROs can specify how cost-of-living adjustments are handled
- Early retirement subsidies and survivor benefits should be addressed
- IRAs don't require a QDRO - just a transfer incident to divorce
- Get the QDRO drafted before the divorce is final if possible
